I'm a copyright attorney who is representing a client for copyright
violations of giddyupflix.com. In doing some research to find other
victims, I ran across this blog. It is absolutely against federal
copyright laws to use others "works" for profit or otherwise (except for
personal use) without the owner's permission or paying a license fee.
You can't just go to Walmart, buy your favorite movies, make a ton of
copies and open up a rental store online or otherwise. There are
federal statutes that make this activity illegal in the United States.
This is how Napster was shut down and those music files were passed
along for free. I advise anyone that has DVDs up on any rental site without their permission to seek legal help immediately.

Hi Kim,

Thank you for the comment. I understand your concerns. As I wrote in some of the earlier comments on this post, I believe rental services are ultimately beneficial to good quality trainers.

From the research I have done, services like giddyUpFlix are completely legal.

Mary

I own a company that has spent thousands filming, editing, producing and marketing DVDs of professional trainers. GiddyUpFlix has now purchased a few of them and renting them with no compensation to me. Perhaps it's legal, perhaps not. I can assure you of this - it's not ethical.

Other companies like Netflix, Video Professor, etc. will contract with the copyright holder and pay them a fee for the use of the DVDs.

I think you might see a legal battle with Giddyupflix - it might even be a class action suit brought by many of those who are being cheated by Giddyupflix.

I would urge you to NOT do business with them - they are hurting the industry.

"Most training and instructional DVDs cost big bucks and it’s often hard to know before hand if you’re going to end up liking it or not (much less whether you’re going to want to watch it multiple times)."

Yes, the state above is true, but for those of us who have paid to produce the video need the sales to help offset that production cost. And video sales are a good part of our income. (I average less than $4,000 a year income for my training business - it's just small time)

I am a SMALL trainer, working with wild horses. The horseflix / giddyupflix folk each bought my video at $45. They are now making $10 a pop to rent it. Within my video it states that it cannot be used for income. There are no laws which prevents them from renting the video after purchase. (yes I know horseflix is no longer doing business.)

All I am saying here is that for the big dudes like Parelli and Anderson, this video rental thing is nothing. But for someone like me, the video sale can be a nice portion of my income for the year.

Thank you.

I think its great I think some of the trainers especially the not as known yet ones are happy to get there name out their.

If you are the filmmaker not sure about the legal aspects of it all but what if you put a warning page before the video begins stating the video is not to be rented out for profit. Put that on the DVD label too.
Make a commercial about what you do or advertise before video starts. I don't know... Just trying to help.

Hi David,

I understand your concern. However, I am under the impression that these services are legal.

I believe that rental services will actually help trainers and film makers that are creating high-quality products. I hardly ever buy training videos because they are so expensive. However, if I rent something and like it, I am likely to buy it so I can rewatch it or buy other products from the same trainer. Rentals are beneficial for trainers because they (if they are good quality) increase brand recognition, increase trust/respect for the trainer and potentially increase sales.

As a film maker who produces films about rodeo, horses, etc, I am trying to find out how you get Giddyupflix to stop renting my DVD, they did not get my permission to use the DVD to rent, I don't rent for the very reason I lose money it cost me to make the film. Please use someone else. They are using these films illegally and I know of several other film makers who are trying to sue them.

Thanks for sharing your experiences Lily. If you switch to another service, I'd love to hear a comparison.

I would not recommend Horseflix for the following reasons:
their service is slow, they charge late fees, if a dvd you mailed back to them in good conscience does not get back to them they charge you 39.99, they have poor customer service response and do not treat you like they value you as a customer.

I used Horseflix service for over a year. I found their service slow (it would take over two weeks from the time i mailed the dvd til i rec'd a new one) but was nontheless patient. When a dvd i mailed back to them was not received, they charged me for a late fee , then said they would charge me 39.99 to replace it. You take this risk with them, if it doesn't get back to them , the customer is held liable. Doesn't matter if you had been a good customer for over a year. Also during the time that they were waiting for this dvd, they charged me my full month's fees, even though i had emailed them back weeks prior that i had mailed back the dvd.

So overall i would not recomment this service.
I contacted GiddyUp and they seemed to have a much larger selection. They also don't charge late fees and they said if a dvd was sent back and lost in the mail thru no fault of customer that the customer would not be held accountable. They seem like they have a much more responsible approach toward treating their customers right.
